BAC above .08 and below .10:
If convicted, the penalties include a loss of license for a period of three (3) months, between twelve (12) and forty-eight (48) hours at the Intoxicated Driver’s Resource Center (IDRC), a possible jail term of up to thirty (30) days, fines between $250 and $400, an insurance surcharge of $1,000.00 per year for three (3) years, and a discretionary jail term of up to 30 days.
BAC above .10:
If convicted, the penalties include a loss of license for a period of between seven (7) months and one (1) year, between twelve (12) and forty-eight (48) hours at the Intoxicated Driver’s Resource Center (IDRC), fines between $300 and $500, an insurance surcharge of $1,000.00 per year for three (3) years, and a discretionary jail term of up to 30 days.
Second Offense
If convicted, the penalties include a loss of license for a period of two (2) years, forty-eight (48) hours at the Intoxicated Driver’s Resource Center (IDRC), fines between $500 and $1,000, an insurance surcharge of $1,000.00 per year for three (3) years, mandatory installation of interlock device or suspension of registration privileges for two (2) years, and a jail term of two (2) to thirty (30) days.
Third Offense or more
If convicted, the penalties include a loss of license for a period of ten (10) years, forty-eight (48) hours at the Intoxicated Driver’s Resource Center (IDRC), a fine of $1,000, an insurance surcharge of $1,000 per year for three (3) years, mandatory installation of interlock device or suspension of registration privileges for ten (10) years, and a mandatory jail term of six (6) months, of which up to ninety (90) days may be served in an in-patient alcohol treatment facility.
